SERIOUS CHARGES. ACQUITTED BY DIRECTION OF JUDGE. Henry Pickles Atkinson. 59. was charged with that he did, on the 21th February, 1925, at Gulgamree, NSW., attempt to carnally know Edna Sampson, aged 5 years and 10 months, also that he did attempt to assault and commit an act of indecency upon the said Edna Sampson. Accused pleaded not guilty. The following jury was empanelled - Messrs. W. T. Rayner. W. Walsh, W. B. Stoddart. H. Gillam, F W. Sills. S. E. Elphinstone, W. H. Gould, H. King, G. Sharpe, L. R. Doble, J. D. Mason and W. J. Palmer. Accused challenged five jurymen before the panel was completed. Mr. E. H. Young (instructed by Mr. E. R. Daniel) appeared for accused.
The Crown Prosecutor placed the facts of the case before the jury. When the mother asked accused what he had done to the child he said she must have fallen on a stake. The child had been examined by Dr. Matheson. When charged with the offence accused said he was innocent. Accused had admitted to the Inspector of Police that he had been out with the little girl. Attempting to carnally know a little girl was a very serious charge. But there must be some corroboration of the little girl's evidence Lily May Sampson (mother of the child) deposed: On the 24th February accused was boarding with us. Later on that date Arthur and Vivian Atkinson, brothers of accused, came to the house. Henry Atkinson went away during the day and Edna and Connie (3 years old) went away also. They left the kitchen shortly after accused departed; I could hear. them in near the tank. Edna came back at ten minutes to 6 o'clock. Heard her crying. Went to her and saw that her face was flushed. Asked her what was the matter. She said : Mr. Henry (meaning accused) hurt me.' She pointed to her leg. I undressed her and examined her. She said: 'Mr. Henry told me not to say anything or tell mummy, and he would give me a ring.' (The witness here fully described the injuries to the child). Accused came in after I had completed my examination of the child. Asked him what he had done to the child. He said: 'She fell on a stake.' He also said': 'if you take the child to a doctor I will put you off the place; it is money you want.' To Mr. Young: Accused has been living with us for nine months. Did not know that Henry Atkinson was a man of considerable means. Did not know that my husband was trying to borrow money from him. My maiden name was Windle. Did not want to buy a motor car. Aly husband was not short of money.. The three owners of the farm (the Atkinson brothers) gave us notice to leave. Edna Sampson was brought into Court. An effort was made to hear her story, but she was crying and would not answer questions. Police Inspector George Jeffrey deposed: on the 25th. February I went to Sampson's place with Constable Jackson. Saw Mr. and Mrs Sampson. It. was in the afternoon. Mrs. Sampson and Constable Jackson were present when I spoke to accused. He said he was innocent of the charge. I cautioned him as to what he said. Accused said: All right; are you going to arrest me? Mrs. Sampson told me that. Edna came in at 5 o'clock and made a complaint. She also said that accused, in reply to the question. 'What have you done to my child?'' said; 'I am innocent; I would not do such a thing.' Accused said the girl had fallen on a stake and hurt herself. Dr. Matheson deposed: Saw the little girl Sampson at Dr. Golledge's surgery in the presence of Dr. Delpratt. (The witness described in detail the injuries sustained by the child). To the Crown Prosecutor: Cannot say how the injuries were caused. They could have been caused by an assault. The 1 1/2 inch scratch on the leg could have been caused six hours before the alleged assault. The injuries to the fluid were not serious at all. S. F. C. Sampson, father of the child, deposed: My daughter Connie told me something. Asked accused : 'What have you done to Edna? He said: ' Nothing.' he also said: 'She must have fallen down coming over the hill and staked herself.' Was present when my wife asked accused what he had done to the child. Examined the child with my wife shortly afterwards. (Witness described the injuries) . After bearing argument Mr. Young and the Crown Prosecutor, the judge ruled that, as the only evidence against accused was circumstantial, it was quite consistent with the innocence of accused, and he took the responsibility of saying that the jury must, on the evidence. return a verdict of not guilty. 'The jury was accordingly directed to return a verdict of not guilty, and did so. Accused was thereupon discharged without having to answer the charge, he having from first to last, asserted his innocence (Mudgee Guardian and North-Western Representative, Thursday 9 April 1925, page 23).

OBITUARY The death of Mr. John Windle last Friday, from natural causes, at the ripe old age of 80 years, marks the passing of yet another of the staunch old pioneers of the Rylstone district, for Jack, as he was known by everyone within 100 miles radius of Rylstone, had lived here for over 60 years. Born at Bathurst in the 50's of last century, he lived in and around that district for a number of years, and following his occupation of general carrier, came to Rylstone as a young man of about 20, his wife accompanying him. Jack had, perhaps, the most intimate knowledge of the country throughout this district of any man who ever resided here, for his occupation as a carrier took him from Wallerawang to Bathurst, to Mudgee and all towns en route and across the ranges to Widden, where his two bullock teams were often to be seen hauling the heavy waggons filled with goods from the city on the up journey, and loaded high with farm produce on the return trip. One team was composed entirely of bald-faced bullocks, and a familiar sight for many years around Rylstone was the baldy team with Jack, a huge figure of a man, striding alongside the team swinging his long whip. Possessed of enormous physical strength, probably the strongest man in the town in his prime, a favorite pastime when in town was to visit one of the smithies' shops in Lue-street, and this scribe, as well as many others who saw him, can vouch for the following occurrences. In the shop stood an anvil weighing sightly over 3cwt., and Jack would take off his greenhide belt, pass it through the hole in the anvil and around the beak, and then placing his hands behind his back, he would take the belt in his teeth, and carry the anvil off its block and across the shop, leaving it there for the smith and his striker to replace as best they might. Deceased is survived by his widow and three sons, Messrs. Ted, Harry and Billy (a fourth son, Jack, being dead), and four daughters, Mesdames S. Morrison, S. Sampson, Godfrey Young and Bayliss, whilst Mrs. Windle, senr., the widow, resides at Kandos. Deceased was laid to rest in the Catholic portion of the Rylstone cemetery alongside his son, John, the Rev. OBITUARY

Mrs. E. Sampson The passing on Friday morning 14th inst., of Mrs. Ernie Sampson, at her residence, Mudgee-street, after a short illness removes yet another old pioneer of the Rylstone district, at the age of 76 years. Deceased was a well-known member of the Robbins family, and had been married to Mr. Sampson just on 56 years. Always to the fore in assisting neighbors in times of stress and illness, this grand old lady will be much missed from among her large circle of friends. Besides the husband, a large family of sons and daughters are left to mourn. The remains were laid to rest in the C. of E. portion of the Rylstone cemetery. The Rev. Richards officiated at the graveside. Children of the deceased are: - Selwyn, Ray, Gordon, Cecil (Rylstone), Garry (Junee), George (deceased), Mrs. H. McLean (Surry Hills), Mrs. R. Wessell (Camperdown), Mrs. J. McLean (Forbes). Two daughters, Mrs. Whitby and Mrs. R. Dunn, predeceased the mother.

Kandos Pioneer Passes On Death of Granny Windle Kandos lost its oldest citizen on Tuesday when Granny Windle was called home. Deceased, who resided with her son and daughter-in-law, Mr. and Mrs. Billy Windle, of Fleming Street, was in her 90th year. The late Mrs. Windle, sen., was a dear soul and was loved by all. Her life was spent in the service of the community. The funeral, which was largely attended, took place to the Catholic portion of the Rylstone Cemetery on Wednesday, the last sad rites being performed by the Rev. Father Kenefick. Mr Selwyn Sampson
The death occurred at his home in Louee Street, Rylstone, early on Saturday morning last of Mr Selwyn Sampson, aged 74 years.
Deceased was well known and highly respected in the town and surrounding district, where he was born and lived practically all hi life. He was a lover of horses and took an active part at the Rylstone-Kandos Show and sports days.
The late Mr Sampson is survived by a widow and family of three daughters and one son, viz, Edna (Mrs Ferguson, Kandos), Connie (Castle Hill), Marion (Rylstone), and Herb (Rosehill). To the bereaved deepest sympathy is extended.
The funeral took place to the Church of England portion of the Rylstone cemetery, Rev Davy performing the last sad rites. Mr J R Simpkins had charge of the arrangements (Mudgee Guardian 11 December 1958).
