RYLSTONE GRAZIER'S DEATH.

Mr. Thomas Ashe, one of the oldest graziers of the Rylstone district, died at Bathurst. Three weeks ago he had an apoplectic seizure. Deceased held large pastoral interests at Capertee and Bogie. He was an inspector for the A.J.S. Bank for a number of years.

Kandos News. Late Mr. Ashe DIED AT PORTLAND Following a protracted illness, the death of Mr. Charles Ashe, occurred at Portland, on Tuesday morning. The deceased who was well known in pastoral circles throughout the State leaves a wife and grown up family which includes Mr. R. C. Ashe, Bogie, and Messrs. E. S. and Cyril Ashe Kandos (Mudgee Guardian and North-Western Representative, Thursday 17 February 1927, page 28).

DEATH OF AN OLD IDENTITY Mr Henry Rathbone Ashe, aged 80 years, died at Bogie on Thursday and was buried in the C. of E. portion of the Rylstone cemetery. Deceased, who came from White Rock, near Bathurst, was a very old resident of the Bogie district, where he was held in high esteem by all who knew him. The deceased gentleman was not married. The burial service was conducted by the Rev. Mathos, of the Church of England, Rylstone (Mudgee Guardian and North-Western Representative, Thursday 7 July 1932, page 8).

RYLSTONE ESTATE Case In Equity Court IN the Equity Court, Sydney, last week an interesting Rylstone case. Public Trustee v. Ashe and others, was dealt with. This was an originating summons taken out by the Public Trustee to determine the title to a share in a station property known as Bogie, in the Rylstone district. The defendants were the 18 next-of-kin of Mr. Henry Rathbone Ashe, deceased. In 1876 Mrs. Elizabeth Ashe, being the life tenant with power of appointment in respect of certain lands known as Bogie, executed a deed of appointment in favor on her death of her son, Henry Rathbone Ashe, and her daughter, Elizabeth Mary (subsequently Mrs. Cleeve), and their issue. In 1891 Henry Rathbone Ashe conveyed to trustees the moiety of the lands which passed to him on the death of his mother on trust for himself during his life and after his death for his issue and, failing issue, then for his 'right heirs.' The Public Trustee was appointed as trustee of this settlement by the Perpetual Trustee Company, which was executor of the surviving trustee under the 1891 deed. Henry Rathbone Ashe died in 1932, a bachelor. By his will he appointed Mr. Reginald Charles Ashe, his nephew, and one of the defendants in these proceedings, to be his executor and to him devised all his property. The court was asked to determine, on construction of the settlements, who were the persons entitled to the beneficial estate in the moiety of the lands settled by Henry Rathbone Ashe or whether any estate or Interest in the lands resulted back to the personal representatives of the original settler. On behalf of the next-of-kin, other than Reginald Charles Ashe, It was submitted by Mr. Henry that Henry Rathbone Ashe's estate was limited to a life estate and that the words 'right heirs' in the deed of 1891 were words of purchase and not of limitation - that on the death of Henry Rathbone Ashe the heirs would be entitled to fee simple. For Reginald Charles Ashe It was contended by Mr. Dudley Williams. K.C., that the rule in Shelley's case applied and that as Henry Rathbone's estate was legal and that of the heirs was legal Henry Rathbone Ashe had a fee simple and the title passed In fee simple to Reginald Charles Ashe under the will. His Honor held that Reginald Charles Ashe was entitled to the fee simple and that the rule in Shelley's case did apply.
